It took ten years for craft brewers to finally pass franchise reform legislation earlier this year. And already there are two disputes between wholesalers and brewers. The first is a dispute between Jack’s Abby Craft Lagers and Atlantic Beverage Distributors as reported in ProBrewer News earlier this month.
Now, a second dispute has arisen between craft brewer and wholesaler Night Shift Brewing and New York-based Loverboy hard teas, which Night Shift distributed in Massachusetts. Night Shift is requesting fair market compensation after Loverboy terminated them without cause.
The state Alcoholic Beverages Control Commission will likely rule on both cases this spring, but the disputes may end up in court where the franchise reform law could be disputed.
