News New York Distributors Move Forward with Lawsuit

The lawsuit pitting New York metro area distributors Boening Bros. and Oak Beverages against Manhattan Beer Distributors, Inc. continues to grind on, moving into the discovery stage in court.

The suite was first file in January.

The two distributors have accused Manhattan Beer Distributors of attempting to “monopolize the beer distribution business in a fourteen county area including Nassau, Suffolk, New York, Kings, Queens, Richmond, Bronx, Westchester, Rockland, Ulster, Orange, Sullivan, Dutchess and Putnam counties.”

The complaint accuses Manhattan Beer of engaging in “a pattern of illegal activities designed to compel certain brewers to breach valid agreements with other distributors, including plaintiffs, and have conspired with other brewers to terminate agreements of distributors, including plaintiffs, and to avoid the protection of laws which prevent the termination of agreements between brewers and distributors.”

The charge of conspiracy has been dismissed, but five other charges remain.
